Abstract
The next election in 2019 will use the basic law of Act Number 7 2017. One out of five arguments of the election act is an election system. The election system which agreed on the act number 7 2017 is an open system election with presidential threshold of 20-25 percent. We discuss presidential threshold issue on 2019 election which uses the result of 2014 election. This rule was reacted by more than ten judicial reviews. This means that the rule is suspectedly breaking the national human right which is granted by the constitution. Candidate legitimation should not rely on the result of the previous election. This study is normative investigation using literally approach and an interview. Through a research on the constitution court verdict from the section 222 Act number 7 2017 judicial review, we found that The Constitutional Court’s decision was refused all of the judicial review.
